PROCTER & GAMBLE FAILS TO SQUASH SPANISH TRADEMARK REGISTRATION

AMERICAN cosmetics giant Procter & Gamble has failed to persuade the European Court of Justice (ECJ) to block the registration of a trademark proposed by a Spanish competitor. Laboratorios Alcala Farma wants European Union trademark rights to a disc-and-two-strikes sign, for cosmetics, perfumes and pharmaceuticals, which could be read 'Oli'. Procter & Gamble fears confusion with its Olay brand. However, the visual appearance of the two marks is very different said the court and so "there is no likelihood of confusion."
