Henkel KGaA, of Düsseldorf, was appealing against the refusal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) - OHIM - to register a three-dimensional symbol shaped as a translucent shampoo white bottle, standing upside-down.
