GERMANY’S GRETHER LOSES TRADEMARK APPEAL

THE EUROPEAN Court of Justice's (ECJ) Court of First Instance of the European Communities has rejected a bid by German cosmetics manufacturer Grether to prevent the EU-wide registration of the 'FENNEL' trademark by Thailand's Crisgo for compact powder, lipstick, eye-shadow, eye-liner, blusher, nail polish and mascara'. Judges backed EU trademark agency, the Office for Harmonisation in the Internal Market (Trade Marks and Designs), OHIM, in ruling there was no likelihood of potential confusion with Grether's 'FENJAL' mark.
