EUROPEAN EVIDENCE WARRANT

BY KEITH NUTHALLA SYSTEM of European evidence warrants has been proposed by the European Commission that would allow judicial authorities in one Member State to issue an order for the collection of information that would have to be obeyed by law enforcement officers in another European Union country.The warrants would by-pass existing and often cumbersome mutual assistance rules and would cover a wide range of evidence, although this would exclude body samples, real-time intercepts and further inquiries, such as expert reports.
