ECJ ORDERS SPAIN TO LIBERALISE CAPITAL GAINS TAX RULES

THE EUROPEAN Court of Justice (ECJ) has told Spain it should cease immediately taxing unrealised capital gains when a company transfers its base or assets to another European Union (EU) member state. Ruling that this breaks EU taxation fairness rules, judges said a company from Spain “is penalised financially as compared with a similar company which carries out such transfers in Spanish territory…,” which does not have to pay such tax. *http://curia.europa.eu/juris/liste.jsf?num=C-64/11
