BY KEITH NUTHALLA judgement by the European Court of Justice (ECJ) due in the next month or so is expected to find that the European Commission should be given a key role in measures to deal with environmental crime. The ECJ is likely to follow the line taken last month by the court's advocate general Damaso Ruiz-Jarabo Colomer who stated that common definitions of environmental crimes and the rules for determining penalties were "first pillar" issues - in other words they should be dealt with on an EU basis.
